I have an upcoming listing that was "supposed to" be vacated by the non-paying tenants on Friday. Instead, the tenant doesn't show up and sends me a text message saying, "I don't have a place to move to." Well, after having done property management for the past 9 years, I've seen and heard just about everything...but no excuse has ever caused a delay of filing an unlawful detainer action against the tenant!
Here are a few other common tenant myths that have been proven wrong in court:
- I didn't sign a lease with the new landlord, so I'm not obligated to pay them rent.
- I have a baby, so even though I'm not paying rent, you can't evict me.
- I don't have to pay rent if the landlord isn't paying their mortgage.
Tenants, the best way to get an eviction on your record (in case you want to encounter difficulties obtaining future housing or perhaps employment, now that most employers check credit reports) is simply to not pay your rent.

Absolutely. You cannot get away with not paying your rent. It is a pain to go through the eviction process but evicted they will be.
A difficult situation when they say they have no where to go, but it's not their property and if they are not paying, they have to leave. Too many people think they are entitled without paying!
Harry, I do tell it like it is! Unfortunately, the tenant already told me that she wasn't moving until the sheriff evicts her, so that is the way it will be unless she changes her mind. Thanks for stopping by to comment! :)

Jane, you're absolutely right! This is definitely not our first eviction and we've had a 100% success rate, so we'll just follow this one through like the rest of them. :)
The sad thing is that this 42-year old woman has two daughters living with her and at least one of them (who is over 18) will have an eviction on their record. Not a very good way to start out their lives and it's hard to believe that a mother would let her children suffer such consequences because of her irresponsible actions. :(

Diane, entitlement seems to be the root of many evils in today's world! When people don't pay their mortgage, they can expect the home to be foreclosed. When people don't pay their rent, they can expect to be evicted. It's as simple as that. :)
