FHA Flipping Waiver Extended

FHA announced it will extend the property flipping waiver until December 31, 2011, This flipping waiver had previously been in force through January 31,2011.

The waiver basically allows properties purchased within the last 90 days to be sold with FHA financing, with a 20% cap on price increase.

In the announcement, FHA Commissioner David Stevens said, "As I noted when we first announced this policy change early last year, because of the tightened credit market, FHA-insured mortgage financing is often the only means of financing available to potential homebuyers."

"Today I can report that this policy change has been effective.  Since the original waiver went into effect on last February, FHA has insured more than 21,000 mortgages worth over $3.6 billion on properties resold within 90 days of acquisition."

The flipping rules are in place to prevent properties from being resold with nominal improvements to unsuspecting buyers at above market, "inflated" prices. It is basically a protection against predatory home selling practices.

The existing flipping policy prohibits sales within 90 days of the original purchase, and places limits on property sales that take place between 90 and 360 days of the original purchase.

The property flipping waiver that was announced in January 2010, and is now extended, opens the market to resales within the first 90 days, with the following restrictions:

  • All transactions must be arms-length, with no identity of interest between the buyer and seller or other parties participating in the sales transaction
  • In cases in which the sales price of the property is 20 percent or more above the seller's acquisition cost, the waiver will only apply if the lender meets specific conditions

This is generally good news, and FHA indicates that the waiver has helped increase home sales. Typically though the 20% above acquisition cost limit is still restrictive for most resales, as the low number of 21,000 resales indicates.

With current tightened lending and appraisal guidelines in place, I suspect that the HUD flipping rules are not needed to prevent resales at "inflated" prices.

Anyway the waiver extension is good news.

Terracina Estates is a custom home community in Loomis, CA (near the border of Granite Bay, CA) with 17 lots encompassing 83 acres. It was developed in 2005 and about one half of the community is built out. The street names in Terracina Estates are: Terracina Lane, Terracina Court and Ruscada Court.

Terracina Estates HOA dues are $295 per month and include the operation and maintenance of the ponds and Bushnell landscaping at the entry. All homes built in Terracina Estates must have at least 4,000 sq. ft. of living area with at least a 3-car garage.

Lot sizes range from 2.5 acres to 4 acres and have sold between $199,000 (most recent sale) and $475,000 (in September 2008). Home sizes range between 4,200 sq. ft. and 10,000 sq. ft. and have sold between $1,027,186 (REO sold on 1/28/09, conventional financing) and $2,500,000 (flip sold on 5/7/10, cash).

The 4-bedroom, 5-bath home built in 2004 on 1.1 acres was on the market for 390 days before it sold on 5/28/10...for $370,000 under the asking price.

Today We Rescued A Cane Corso Whose Daddy Was Deployed To Afghanistan

First, I'd like to thank Cris Tarozzi (and Denise!) of the White Kitty Foundation in Walnut Creek, CA for their hard work and efforts in getting a Cane Corso named Max out of a high-kill shelter, Contra Costa County Animal Services in Martinez, CA.

Max was surrendered to the shelter on January 15, 2011 when his active duty military owner from San Ramon, CA got deployed to Afghanistan. The employees at Contra Costa Animal Services were not equipped to handle the adoption of such a large breed of dog (140 lbs.) so Max was scheduled to be put down...until Cris and Denise went to work trying to save his life and contacted Bob after finding our website California Cane Corso.

Contra Costa Animal Services is attempting to contact Max's owner to let him know that his dog was not put down and that he is in foster care. We hope for his safe return after his deployment and would love to return Max to him. It just broke our hearts at the thought of someone serving our country at the expense of losing his dog, so that's why we couldn't allow him to be put down. Thanks, Cris and Denise, for adopting him out of the high-kill shelter!

Max is his call name, but his official name is Roman's Tiberius Maximus and he was bred by Marty Giarocco of Roman Cane Corso in Pennsylvania. He comes from mostly Roman Cane Corso dogs, but he also has Scandifio Cane Corso, Di Guardia Cane Corso and Bel Monte Cane Corso in his bloodlines.

I do not know if the breeder Marty Giarocco of Roman Cane Corso was contacted by Max's owner (who purchased him as a puppy) to notify him that he was being deployed and could not keep Max...but responsible breeders should ALWAYS have an open door and a helping hand for any puppy they produce.

Unfortunately, the vast majority of breeders are NOT responsible, so that's why we have an abundance of animals in rescues and shelters.
